These Terms and Conditions ("Terms") govern access to and use of the worldFURY Swimmingly CRM platform ("Platform"), operated by Fury Construction LLC, a Colorado limited liability company ("Company," "worldFURY," "we," "our," or "us").
By creating an account, accessing the Platform, or using any services provided through the Platform, you agree to be bound by these Terms.
worldFURY Swimmingly CRM is a business management and networking platform that allows contractors, customers, and authorized users to manage contacts, estimates, jobs, communications, tools, vehicles, schedules, and business information.
The Platform is provided solely as a software service and does not act as a contractor, subcontractor, agent, broker, employer, insurer, legal advisor, financial advisor, or representative of any user.

Estimates, proposals, pricing information, schedules, quantities, materials, labor rates, and project information are entered by users.
The Company makes no warranty regarding:
Users are responsible for independently verifying all information.
The Platform may allow contractors and customers to connect, communicate, share information, provide feedback, or request services.
The Company:
Participation occurs entirely at the user's own risk.
Users retain ownership of information they upload.
By submitting content, users grant Company a non-exclusive, worldwide license to store, display, process, transmit, and reproduce such content solely for operation of the Platform.
Users represent that they possess all rights necessary to upload submitted content.
Users may not:

Users may submit feedback regarding other users.
The Company does not verify the accuracy of reviews.
Users are solely responsible for statements submitted through the Platform.
The Company reserves the right to remove content at its sole discretion.

The Company does not guarantee:

Users are responsible for maintaining backups of critical business information.
The Company shall not be liable for:
To the maximum extent permitted by law, Company and its owners, officers, members, managers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages.
In no event shall the total liability of Company exceed the amount paid by the user to Company during the twelve (12) months preceding the claim.
If no fees were paid, liability shall not exceed One Hundred Dollars ($100.00).
Users agree to defend, indemnify, and hold harmless Company and its affiliates from claims, damages, liabilities, losses, costs, and attorney fees arising from:
All software, trademarks, branding, logos, designs, source code, and proprietary materials associated with worldFURY Swimmingly CRM remain the exclusive property of Company.
No ownership rights are transferred to users.
The Company may suspend or terminate any account at any time, with or without notice.
Termination may result in deletion of account data.
The Company is not obligated to retain user data after termination.
The Company may modify, discontinue, add, or remove features at any time without liability.
These Terms shall be governed by the laws of the State of Colorado without regard to conflict-of-law principles.
Any dispute arising from these Terms shall be exclusively resolved in the state or federal courts located in Colorado.
Users consent to the jurisdiction of such courts.
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between the user and Company regarding the Platform and supersede prior agreements and understandings.
